The highly controversial Purdue Pharmaceuticals, Sackler Family agreement by Judge Drain on Sept. 1, 2021. What I have found is an increasingly dangerous drug environment for drug users with Fentanyl entering into the picture, often exacerbated by guidelines that are not based on research and attitudes that are detrimental to those who are affected.

One of the first consequences of increased demand for drugs is that these illegal drugs become cheaper over time, such as the prices for heroin and cocaine have been declining for decades. Political economists explain that this demand, combined with globalization, increases competition and efficiency, resulting in more and more illegal drugs are on the black market, which in turn lowers prices.

Secondly, drugs are getting stronger in response to drug bans. Stronger products in smaller packages are easier to transport and harder to detect by law enforcement efforts. The US overdose crisis has been an example of the devastating interaction between demand and prohibition.

In 1996, OxyContin was launched and marketed as a revolutionary intervention in medical pain management. The growing heroin market paved the way for Fentanyl to enter the US illegal drug market. Fentanyl, a drug for severe pain, is 50 times more potent than heroin. In terms of shipping and traffic efficiency, fentanyl is easier to transport and sell than heroin. Fentanyl’s entry into the illegal drug market, especially when combined with heroin, has resulted in a doubling and tripling of overdose deaths between 2012 and 2013.

Since then, Fentanyl has polluted the supply of illegal drugs in the United States: it is often found not only in heroin, but also in cocaine, MDMA, known as ecstasy, methamphetamine, and counterfeit prescription pills. The result is that individuals who take these drugs do not know what are the contents or percentage mixtures or even if it’s real heroin they are using.

With the growing overdose crisis, the community of color, in particular, has seen an increase in fatal overdoses, and these deaths that are often preventable. The Associated Press reported that David Sackler, one of the grandsons of the 3 brothers who started Purdue nearly 70 years ago, says Purdue Pharma will not give billions of dollars to legal arrangements unless they get Total Immunity From The Crimes they are charged with and all current and future lawsuits for company activities. The Bankruptcy Trustee of the US, nine states, and the District of Columbia have opposed the company’s proposed settlement because it would provide legal protection to members of the wealthy Sackler family, although none of them have filed for bankruptcy. It’s like Joaquín “El Chapo” Guzmán, a Mexican drug lord and former leader of the Sinaloa Cartel says that it was the Sinaloa Cartel, not the “El Chapo Family” that was responsible for the deaths of 500,000 people in the States, millions of people addicted to OxyContin which is Heroin and the 70,000 people who died from Opioids in 2020 in the United States, which now is a New Record of people dying in this Opioid Epidemic. It is only going to get worse, there are millions of addicted suffers in the US right now, and they will eventually die from their Heroin addiction.

“We need a sufficient release (freedom from all crimes) to achieve our goals (to continue our crimes),” Sackler said in response to a question from an attorney for the United States bankruptcy trustee. “If the release fails to do that, we won’t support it.” Denying that they, the Sackler family have no legal responsibility for the drug epidemic since Purdue (which they own) marketed the opioids, Sackler said we have a moral responsibility to try to help and that’s the point of the agreement. Harrington stated the court had to grant his motion of suspension because the federal government “has a significant chance of succeeding in the appeal and because the harm that would result from the refusal of the stay outweighs the potential harm of the provision”.

The controversial deal was approved earlier in September by Judge Robert Drain, a federal judge in White Plains, New York. This could mean that the Sackler family, which owns Purdue Pharma, could be released of any future legal liability if they made a financial contribution of $4.3 billion from their own assets.

It’s like saying if Judge Drain releases El Chapo Guzmán, Joaquín (like Richard Sackler) promises to donate 4 or 5 billion dollars of his own fortune to help the people the Sinaloa Cartel killed with the Sinaloa Cartel’s heroin.

Harrington argued with the filing that the court of appeals ruled that the transaction deal had deprived those who had lawful lawsuits against the Sackler Family “without their knowledge and consent, adequate notice or even the opportunity to be heard”.

“The federal government’s case was also supported by previous Supreme Court rulings”, Harrington stated.

The US Justice Department filing is the latest in a long struggle and battle to get the Sackler family to admit their responsibility and be accountable for the manufacturing, marketing lies, and the selling of the drug OxyContin, a highly addictive and deadly painkiller.

As more and more people died from opioid use, the plaintiffs sued Purdue. When the company filed for bankruptcy in September 2019, 2,900 lawsuits were known, of which more than 600 were named against the Sacklers. The bankruptcy proceedings put an end to these lawsuits. The Sackler family withdrew all the money from Purdue prior to 2019.

Judge Drain approved the settlement plan after careful negotiations between the family, local authorities, the hospital system, and others who have sued the company and are likely to be involved in costly litigation in the years to come.

Those who support the agreement, including most states and some plaintiffs, say it will provide much-needed funding for drug treatment programs.

Steve Miller, CEO of Purdue, said the agreement “ensures billions of dollars will be available to help people and communities affected by the opioid crisis.” Several members of the Sackler family said the resolution was an important step in addressing the public health crisis that they started.

However, critics say the term unfairly protects the Sacklers. It offers families the protection normally afforded to insolvent companies, but not to entrepreneurs who have not gone bankrupt themselves.

The US Justice Department and various states have appealed Drain’s decision.
